Terms of Service

BrainEase is an app designed to promote mental relaxation, mindfulness, and the establishment of an evening routine. The app is not a medical device and does not provide medical, psychological, or psychiatric advice, diagnosis, or treatment.

The comments and classifications the app generates for your thoughts serve information and relaxation purposes only. If you have health concerns or psychological problems, please always consult a qualified doctor or therapist. In an acute crisis or emergency, please contact emergency services or a crisis/telephone counseling service immediately.

Using BrainEase requires a minimum age of 16. Minors may only use the app — in particular any paid features — with the consent of their legal guardians. By using the app, you confirm that you meet these requirements.

BrainEase can be used free of charge in a limited basic version. Certain features (e.g. unlimited AI thought sorting) require a paid subscription or a one-time purchase ("Premium").

Purchases and subscriptions are processed exclusively through the respective app store (Apple App Store or Google Play Store). The contracting party for payment processing is the respective store operator; its payment, usage, and cancellation terms apply in addition.

Subscriptions automatically renew for the selected term unless cancelled at least 24 hours before the end of the current period in the account settings of the respective app store. Managing and cancelling a subscription is done directly in your Apple or Google account.

For certain subscriptions, we offer a free trial period (e.g. 3 days). At the end of the trial period, the subscription automatically converts into a paid subscription at the displayed term and price, unless you cancel at least 24 hours before the end of the trial period in the account settings of the respective app store. The free trial is generally available only once per Apple ID or Google account; the exact conditions are set by the respective store operator.

For digital content provided immediately after purchase, the following applies: by starting to use a paid feature, you expressly agree that we begin performance of the contract before the 14-day withdrawal period expires. You acknowledge that your statutory right of withdrawal expires once the contract has been fully performed (§ 356(5) of the German Civil Code, BGB). Mandatory consumer protection rights remain unaffected. During a free trial period you incur no costs; if you do not cancel the trial in time, the foregoing applies accordingly to the subsequent paid period.

Refunds: Since all payments are processed via the Apple App Store or Google Play Store, refunds can only be issued by the respective store operator in accordance with its refund policies. We ourselves have no access to your payment data and cannot refund payments directly. Please direct refund requests to:

• Apple App Store: via reportaproblem.apple.com or Apple support channels.
• Google Play Store: via the "Orders & Subscriptions" section of your Google account or Google Play support.

Any statutory warranty or refund claims against us remain unaffected by the store policies.

BrainEase uses artificial intelligence technologies to structure your thoughts. To ensure smooth operation for all users, use is subject to a daily fair-use limit.

Results generated by the AI are produced automatically and may be incomplete, inaccurate, or inappropriate. They do not constitute professional advice and are provided without guarantee.

You agree not to misuse the app. It is prohibited to enter unlawful, extremist, offensive, or otherwise inappropriate text into the app. SD Nightshift Studio reserves the right to temporarily or permanently restrict the AI functionality for the affected app installation in the event of excessive or abusive use.

The AI features depend on external third-party services (in particular OpenAI) as well as an active internet connection. We have no control over the availability of these third-party services.

We therefore make no guarantee of continuous, uninterrupted availability of the AI analysis or the underlying servers. Temporary disruptions, maintenance work, or outages (e.g. due to an outage at the AI provider) do not constitute a defect and do not give rise to a claim for a refund, as long as the app's core function (local journaling) remains available.

Should an essential paid feature be unusable for a significant, continuous period, your mandatory statutory rights as a consumer (e.g. to a price reduction) remain unaffected. We strive to resolve disruptions promptly.

Protecting your private thoughts is our highest priority. BrainEase stores your journal entries encrypted and locally on your device by default. Data is transmitted to external servers only temporarily, as part of the AI analysis. This data is not used to train AI models.

SD Nightshift Studio is liable without limitation for intent and gross negligence. For slight negligence, we are only liable in the event of a breach of material contractual obligations (cardinal obligations), the fulfillment of which is essential for the proper execution of the contract in the first place. In this case, liability is limited to foreseeable damage typical for this type of contract. Liability under the Product Liability Act as well as for injury to life, body, or health remains unaffected.

We make no guarantee of continuous, uninterrupted availability of the app or the underlying server and AI services (see also Section 6). Since the app operates without user accounts and your data is stored exclusively locally on your device, it is solely your responsibility to regularly create manual backups (using the app's export function) to avoid data loss in the event of a device change or app loss.

The law of the Federal Republic of Germany applies, excluding the UN Convention on Contracts for the International Sale of Goods. Insofar as the user is a consumer, mandatory statutory consumer protection provisions of the state in which they have their habitual residence remain unaffected.

Consumer dispute resolution: We are not willing and not obligated to participate in dispute resolution proceedings before a consumer arbitration board.
